APPLICANT REQUESTS THAT:
His Defense Meritorious Service Medal (DMSM), Second Oak Leaf
Cluster (DMSM w/2OLCs) start date be changed to 12 Jun 08 versus
11 Jun 07.
APPLICANT CONTENDS THAT:
The start date on his DMSM is incorrect due to an administrative
error, as most awards in theater did not have the same year for
beginning and completing a deployment.
The Board should consider his untimely application in the interest
of justice because he is being given an additional year of credit
towards his federal service computation date that he neither
earned nor wants.
In support of his request, the applicant provides copies of AMC
Form 148G, Boarding Pass/Ticket and a special order.

STATEMENT OF FACTS:
On 30 Apr 09, the applicant retired from active duty in the grade
of lieutenant colonel.
AIR FORCE EVALUATION:
AFPC/DPSID recommends denial. The documentation demonstrates the
existence of an error in the applicants inclusive period start
date for his DMSM w/2OLCs. However, due to the DMSM being a
joint/defense decoration, he will need to appeal to the Director,
Military Personnel: Human Resources Directorate, Washington
Headquarters Services, Washington, DC 20301-1155. To grant relief
would be contrary to the eligibility criteria established by DoDM
1348.33, Manual of Military Decorations and Awards, the Secretary
of the Air Force (SECAF), Chief of Staff, and/or the War
Department.

APPLICANTS REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant
on 17 Feb 15, for review and comment within 30 days (Exhibit C).
As of this date, this office has not received a response.
THE BOARD CONCLUDES THAT:
1. The application was not timely filed.
2. The applicant has not exhausted all remedies provided by
existing law or regulations to warrant consideration of his
request to change his DMSM w/2OLCs start date to 12 Jun 08 rather
than 11 Jun 07. In this respect, we not this Board is the highest
level of administrative appeal within the Air Force. As such, an
applicant must first exhaust all available avenues of
administrative relief provided by existing law or regulations
prior to seeking relief before this Board, as required by the
governing Air Force Instruction. The Air Force office of primary
responsibility reviewed this application and indicated there is an
available avenue (Director, Military Personnel: Human Resources
Directorate, Washington Headquarters Services, Washington, DC) of
possible administrative relief the applicant has not exhausted.
In view of this, we find this portion of the application is not
ripe for adjudication at this level as there are subordinate
levels of appeal that have not been depleted.
THE BOARD DETERMINES THAT:
The applicant be notified that he has not exhausted all available
avenues of administrative relief prior to submitting her
application to the BCMR; and the application will only be
reconsidered upon exhausting all subordinate avenues of
administrative relief.
